Message: Joseph, I need legal advice regarding my current mortgage servicer. I have tried to achieve a loan modification since June of 2009 and have after 4 attempts been unsuccessful. GMAC Mortgage purchased this loan from New Century Mortgage, and to my knowledge does not have my signature on a loan agreement with them. I have also been informed that If my loan has been sold to a new servicer, that new servicer does not have a contract with me and can not demand payment from me unless I have signed and agreed to pay this new servicer. I have recently contracted with a real estate brokerage to have a forensic loan audit performed to seek out flaws and illegalities in the loan agreement they have in their possession, and determine if they have my signature (which they don't) in their loan documents. The brokerage I hired informed me today that they are unable to service my request. They have determined that I make too much money when I have proven via tax returns that I have lost over $100,000.00 in income between 2008 and 2009. I believe my current loan servicer, GMAC Mortgage may have provided them with invalid or incomplete loan documentation, or otherwise inaccurate information. Is it true that if my current loan servicer GMAC Mortgage does not have a signed contract with me, I am not bound to pay them, and I can receive the deed to my home? I need this investigated and if true, pursue the matter ASAP.
